These Terms and Conditions (“Terms”) govern your use of learn.neszant.com (“Platform”) and the training services offered on it (“Services”). The Platform is operated by Neszant Technology Solutions Pvt Ltd, Featherlite The Address, 8th Floor, 200 Feet Radial Road, Zamin Pallavaram, Chennai 600 044, Tamil Nadu, India, and Neszant Technology Solutions Inc, Austin, Texas, USA (together, “Neszant”, “we”, “us”). Your contract is with the entity that invoices you: the Pvt Ltd for learners in India, the Inc for learners elsewhere.
This document is an electronic record under the Information Technology Act, 2000 and rules made thereunder, and is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011. It does not require a physical or digital signature. By accessing or using the Platform, you agree to these Terms; if you do not agree, please do not use the Platform.
1. Services
Neszant provides live, instructor-led online training in cloud and DevOps technologies, together with related materials such as lab guides and recordings. Course schedules, fees, and inclusions are stated on the Platform at the time of enrollment. A batch is scheduled once a minimum of 5 learners enroll.
2. Enrollment and Your Account
- You agree to provide true, accurate, and complete information when enrolling and to keep it up to date. You are responsible for activity carried out through your registered details.
- You must be 18 years or older, or enroll through a parent or legal guardian who accepts these Terms on your behalf.
- Enrollment is personal to you. Login credentials, session links, and course materials may not be shared, resold, or transferred.
3. Fees and Payment
- Fees are published on the Platform: in INR for learners in India (18% GST applies) and in USD for international learners.
- Payments are processed by our payment partners — PhonePe (India) and Stripe (international). We do not store your card, bank, or UPI details.
- By initiating a payment you enter into a binding contract with the invoicing Neszant entity for the selected Services.
- Certification exam fees are charged separately by the certifying bodies (Microsoft, AWS, CNCF, HashiCorp) and are not included in course fees unless expressly stated.
4. Cancellations and Refunds
Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. In summary: a full refund if your batch does not reach the minimum size within 30 days, a full refund for cancellations at least 48 hours before the first session, and a prorated refund within the first three sessions.
5. Intellectual Property
All Platform content and course materials — including curriculum, lab guides, recordings, design, and graphics — are owned by or licensed to Neszant. You receive a personal, non-transferable licence to use them for your own learning. You may not reproduce, distribute, publish, or commercially exploit them without our written consent.
6. Acceptable Use
You agree not to use the Platform or Services for any purpose that is unlawful or prohibited by these Terms or by laws applicable to you, not to disrupt sessions or other learners, and not to attempt unauthorized access to the Platform. Unauthorized use may lead to suspension of access and action under applicable law.
7. Disclaimers and Limitation of Liability
- The Services and materials are provided with reasonable skill and care, but we do not warrant that they are error-free or suited to any specific purpose, and we do not guarantee certification exam results, employment, or any particular career outcome.
- The Platform may contain links to third-party websites; your use of those sites is governed by their own terms and policies.
- To the fullest extent permitted by law, Neszant’s total liability arising out of the Services is limited to the fees you paid for the course concerned. Neither party is liable for failure to perform caused by events beyond its reasonable control (force majeure).
8. Indemnity
You agree to indemnify and hold harmless Neszant, its affiliates, and their officers, directors, and employees from claims, demands, or penalties (including reasonable attorneys’ fees) arising out of your breach of these Terms or your violation of any law or third-party rights.
9. Governing Law
Where your contract is with Neszant Technology Solutions Pvt Ltd, these Terms are governed by the laws of India and the courts of Chennai, Tamil Nadu have exclusive jurisdiction. Where your contract is with Neszant Technology Solutions Inc, these Terms are governed by the laws of the State of Texas, USA and the courts of Travis County, Texas have exclusive jurisdiction.
